§2Takedown notice requirements
To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- A physical or electronic signature of the copyright owner (or someone authorized to act on their behalf);
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works at a single site, a representative list);
- Identification of the material claimed to be infringing, with enough detail (URL is best) to allow Prestige to locate it;
- Your contact information: name, address, telephone number, and email;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on the owner's behalf.
Send the completed notice to dmca@prestigeecosystem.com or by mail to the address in §1.
§3What happens after we receive a valid notice
- We remove or disable access to the allegedly infringing material expeditiously;
- We forward your notice to the uploader (with your name and contact information attached, as the law requires);
- We inform the uploader of their right to file a counter-notification;
- We log the takedown and apply it to the uploader's account history (relevant for §5).
§4Counter-notification
If you believe your material was removed in error, you may submit a counter-notification under 17 U.S.C. § 512(g)(3). It must include:
- Your physical or electronic signature;
- Identification of the material removed and its prior location;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification;
- Your name, address, and phone number;
- A statement that you consent to the jurisdiction of the federal district court for your address (or for Prestige's location if you're outside the US) and that you will accept service from the original complainant.
On receipt of a valid counter-notification, we forward it to the original complainant. If they do not file a lawsuit within 10–14 business days, we may restore the removed material.
§5Repeat infringer policy
Consistent with 17 U.S.C. § 512(i), Prestige terminates Members and Brokers who are repeat infringers — generally, three or more substantiated takedowns within a 12-month period. Termination is reviewed individually; we don't apply a rigid count to vexatious or pattern abuse.
